EU Court Imposes 200 Million Euro Fine and Daily Penalty

Violation of EU Obligations Leads to Significant Penalty

In a significant ruling, the European Union's (EU) top court has ordered Hungary to pay a substantial fine for failing to implement changes to its asylum policy. The European Court of Justice (ECJ) imposed a fine of 200 million euros (approximately 216 million US dollars), along with a daily penalty of 1 million euros, for Hungary's non-compliance with EU asylum laws.

The ECJ found that Hungary had violated its obligations under the EU's Asylum Procedures Directive by failing to provide asylum seekers with adequate access to asylum procedures, limiting their access to legal assistance, and detaining asylum seekers in inappropriate conditions.

The court's decision stems from a case brought by the European Commission, which had taken Hungary to court over its asylum policy. The Commission argued that Hungary's actions had violated the principle of non-refoulement, which prohibits the return of individuals to countries where they may face persecution or serious harm.

The fine imposed by the ECJ is a significant blow to Hungary's government, which has been criticized by the EU and international organizations for its restrictive asylum policies. The ruling serves as a reminder that EU member states have an obligation to uphold EU laws and protect the rights of asylum seekers.
